Workers’ Compensation Subrogation, as set forth in sections 3850, et seq., of the California Labor Code, describes the procedures by an employer and an employer’s insurance carrier against third parties, whose fault results in an employee’s industrial injury. The employer and an employer’s insurance carrier have the right to pursue recovery of the amount of compensation paid to the employee or, the employees dependents, following the injury.
